Do I Require Planning Permission for a Garden Office in Scotland?

In most cases, No, planning permission is not required for a garden office in Scotland, provided certain conditions are met.

Q. What will the garden office be used for?

A. Garden offices are typically used as a workspace for home working, meetings, administration or creative work. This type of use is classed as incidental use, meaning it is secondary to the main dwelling and does not usually require planning permission.

If the garden office is intended to be used as sleeping accommodation, rented as a separate unit, or operated as a business with regular public visitors, it may be treated differently and planning permission could be required.

Planning restrictions

  • The garden office is located to the rear of the property
  • At least 50% of the garden remains undeveloped
  • The overall height does not exceed permitted development limits
  • The property is not within a conservation area
  • The property is not a listed building

Building regulations and building warrants

Building regulations and building warrants are separate from planning permission. In many cases, a garden office will not require a building warrant if the following conditions are met.

  • The structure is under 30m² in size
  • It is not connected to mains water or drainage
  • It is positioned at least 1 metre from the property boundary
