Do I Require Planning Permission for Garden Rooms in Scotland?

The simple answer is No, but there are a few key considerations to make sure this applies to your build.

Q. What is the garden room being used for?

A. If your garden room is used for things you would not normally do in your main home (for example a games room, gym, entertainment space, studio, or hobby room) it is usually classed as incidental use (secondary use) and does not require planning permission.

If your intended use includes sleeping accommodation, it is treated differently and planning permission would be required.

Planning restrictions

  • Structure is erected toward the rear of your property
  • A minimum of 50% of the garden remains undeveloped
  • Maximum height of the eaves is no higher than 3 metres
  • The property is not situated within a conservation area
  • The property is not a listed building

Building regulations and building warrants

Building regulations are often confused with planning permission and building warrants, but they are not the same thing. There is no requirement to comply with building regulations if the points below are met.

  • Structure is less than 30m²
  • Not connected to mains water or drainage
  • Minimum of 1 metre from the boundary
