Do I Require Planning Permission for a Garden Bar in Scotland?

In most cases, No, planning permission is not required for a garden bar in Scotland, provided certain conditions are met.

A. Garden bars are typically used for socialising, entertaining, relaxing or as a hobby space. These uses are classed as incidental use, meaning they are secondary to the main dwelling and do not normally require planning permission.

If the garden bar is intended to be used as sleeping accommodation, rented out, or as a self-contained living space, it would be treated differently and planning permission would likely be required.

Planning restrictions

The garden bar is located to the rear of the property
At least 50% of the garden remains undeveloped
The overall height does not exceed permitted development limits
The property is not within a conservation area
The property is not a listed building

Building regulations and building warrants

Building regulations and building warrants are separate from planning permission. In many cases, a garden bar will not require a building warrant if the following conditions are met.

The structure is under 30m² in size
It is not connected to mains water or drainage
It is positioned at least 1 metre from the property boundary
